2. Nature of Our Services

Our offerings include but are not limited to: online courses, digital products, live and recorded weekly group meditation calls, one-on-one phone sessions, in-person retreats, group events, guided meditations, spiritual teachings, personal development materials, and related content. All services are spiritual, philosophical, meditative, and consciousness-expansion oriented. They are not intended to serve as medical, psychological, psychiatric, therapeutic, legal, financial, or professional advice of any kind.

Participation in any Swedish Buddha activity is voluntary and based on the participant’s personal spiritual journey. We do not diagnose, treat, cure, or prevent any disease or condition, nor do we claim to do so.

3. Comprehensive Health and Medical Disclaimer

IMPORTANT: READ THIS SECTION CAREFULLY

Our services, teachings, meditations, retreats, phone calls, and recordings are offered solely for spiritual and personal growth purposes. They are not a substitute for professional medical care, psychological counseling, psychiatric treatment, or any form of conventional healthcare. Participation may trigger intense experiences including emotional releases, physical sensations, spiritual emergencies, kundalini phenomena, surfacing trauma, anxiety, dissociation, fatigue, or other temporary or prolonged states.

If you have any pre-existing physical, mental, emotional, psychological, or psychiatric condition - including but not limited to anxiety, depression, bipolar disorder, schizophrenia, epilepsy, heart conditions, high or low blood pressure, pregnancy, recent surgery, or any other medical issue - you must consult with a qualified licensed healthcare professional before participating in any Swedish Buddha service or event.

Swedish Buddha, Sharpitude Consulting AB, its owners, facilitators, teachers, and affiliates expressly disclaim any responsibility whatsoever for any adverse physical, emotional, mental, psychological, or spiritual effects that may arise from participation in our services. This includes, without limitation: emotional releases, spiritual emergencies, kundalini experiences, heightened sensitivity, temporary discomfort, anxiety, dissociation, physical sensations, fatigue, or any other experiences that may occur during or after meditations, retreats, or sessions.

4. Assumption of Risk

You acknowledge that spiritual practices, group events, retreats, and related activities involve inherent risks (physical, emotional, psychological, and logistical). You voluntarily assume all risks, known and unknown, and agree that Swedish Buddha is not responsible for mitigating them beyond standard facilitation. You acknowledge and agree that you are solely responsible for your own health and well-being. You agree to participate at your own risk and release Swedish Buddha and all related parties from any and all claims, demands, damages, liabilities, costs, or expenses (including legal fees) that may arise out of or relate to your participation.

We strongly recommend that individuals with serious psychiatric histories, trauma, or unstable mental health conditions refrain from participating without explicit written clearance from their treating physician or therapist. All participation is voluntary and entirely at your own risk. You are solely responsible for your own health and well-being. You agree to stop participating and seek professional help if you experience distress. Swedish Buddha does not screen participants for medical or psychological suitability and assumes no duty to do so.

5. Recording and Public Dissemination Policy

Weekly group meditation events, live calls, retreats (when recorded), and other group sessions are routinely audio- and/or video-recorded. These recordings are made available publicly or to members as part of our teaching library, for marketing purposes, on our website, YouTube, podcast platforms, social media, or other channels.

By joining any live group session without notifying the facilitator in advance or at the beginning of the session that you do not wish to be recorded, you give your explicit, informed consent to the following:

- The recording of your voice, image (if video), name, and any statements you make.

- The editing, reproduction, distribution, broadcasting, publication, and public dissemination of such recordings worldwide in perpetuity.

- The use of your likeness and voice in promotional materials.

If you do not wish to be recorded, you must inform us before or immediately at the start of the session. We will make reasonable efforts to accommodate you (e.g., by muting recording for your line or allowing silent participation), but we cannot guarantee complete exclusion in all technical setups. You may also choose to leave the session.

We rely on our legitimate interest (Article 6(1)(f) GDPR) to create and share spiritual teachings for the benefit of the wider community. By participating, you waive any right to privacy, publicity, or compensation regarding your appearance in these recordings.

We use industry-standard security (SSL/TLS, secure hashing, etc.) to protect your information. Our site is built on WordPress, Wix, and WooCommerce. For full details or privacy requests pursuant to GDPR legislation, please contact us. We process data in full accordance with GDPR.

6. Age Requirement

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to purchase services or participate in events. If you are under 18, you may only participate with the express written consent of a parent or legal guardian, who must also accept this full disclaimer and waiver on your behalf.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, Sharpitude Consulting AB, Swedish Buddha, and all associated parties shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or in any way connected with:

- Your use of our website, services, products, or content.

- Your participation in any live or recorded session, retreat, or event.

- Any information, teachings, or guidance provided.

- Any actions or decisions you make based on our content.

- Any technical issues, interruptions, or errors.

- Any emotional, psychological, physical, or financial harm.

Our total cumulative liability to you, regardless of the cause, shall not exceed the total amount actually paid by you to Swedish Buddha during the six (6) months immediately preceding the claim. Some jurisdictions do not allow certain limitations; in such cases, our liability is limited to the maximum extent permitted by applicable law.

8. Waiver and Release of Claims

By participating, you hereby irrevocably release, waive, and forever discharge Swedish Buddha, Sharpitude Consulting AB, its owners, facilitators, employees, agents, contractors, and successors from any and all claims, liabilities, injuries, damages, losses, or causes of action (known or unknown, foreseen or unforeseen), that may arise from your participation.

This waiver includes claims based on negligence, gross negligence, strict liability, breach of contract, or any other legal theory. You intend this release to be as broad and inclusive as permitted by law.

9. Retreats and In-Person Events – Additional Terms

For in-person retreats and events, you agree to:

- Follow all instructions from facilitators regarding safety and conduct.

- Accept full responsibility for your personal belongings and safety.

- Release us from liability for any injury, illness, loss, or damage occurring during travel to/from, or while attending the retreat.

- Comply with venue rules and local laws.

We are not responsible for any accidents, injuries, theft, or medical emergencies at retreat venues. Travel, accommodation, and insurance are your sole responsibility. We strongly recommend purchasing comprehensive travel and health insurance.

10. Intellectual Property

All content, teachings, meditations, recordings, writings, logos, and materials provided by Swedish Buddha are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, or publicly perform any of our materials without express written permission. Limited personal use is permitted for your own spiritual practice, but commercial use is strictly prohibited.

11. Payments, Refunds, and Cancellations

When you complete an order, you will receive an order confirmation by email. Please notify us immediately at kontakt@swedishbuddha.se if anything is incorrect. All sales are final unless otherwise stated or required by law. We reserve the right to refuse or cancel any order or participation at our sole discretion.

Subscription services (such as Buddha Weekly), may be canceled at any time but will continue until the end of the paid period. No prorated refunds are issued unless required by law.

Private sessions (such as the intro call or a booked session from a package), may be cancelled within 24h of the time of the call. If cancelled later than 24h before the call, we retain the right to charge in full.

Retreat reservations may be cancelled no later than four (4) weeks prior to the retreat start date and will be entitled to an eighty percent (80%) refund of the fees paid, subject to these terms and conditions. Thereafter, your reservation is non-cancellable; however, you may assign or transfer your reservation to another individual upon written notice to the organizer. In the event you are unable to attend due to illness prior to the commencement of the retreat, your payment will be retained as credit and may be applied toward private sessions. Such credit must be used within six (6) months from the date the retreat was originally scheduled to occur. This provision ensures that you receive value for your payment notwithstanding your inability to participate in the retreat.

All prices are in USD or SEK and include applicable VAT for relevant countries (6% on books, 25% on other products/services). We reserve the right to correct pricing errors.

12. Governing Law and Dispute Resolution

This agreement shall be governed by the laws of Sweden. Any disputes shall be resolved exclusively in the courts of Gothenburg, Sweden. You agree to waive any objections based on venue or inconvenient forum.

13. Force Majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to acts of war, terrorism, pandemics, government restrictions, natural disasters, or technical failures.

14. Changes to This Disclaimer

We reserve the right to update or modify this document at any time. Continued use of our services after changes constitutes your acceptance of the revised terms. We encourage you to review this page periodically.

15. Severability

If any provision of this document is found to be unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

This document represents the entire agreement between you and Swedish Buddha regarding the subject matter and supersedes all prior understandings or agreements.

17. Acknowledgment

By purchasing, registering, attending, or participating in any way, you confirm that:

- You have read and understood this entire document (over 1800 words).

- You are of sound mind and legally competent to enter into this agreement.

- You voluntarily accept all risks associated with spiritual practices and group events.
